Lindsay Lohan Fights Father, False Reports

Lindsay Lohan's attorney, John Lavely, sent out a seven-page letter on Wednesday, Feb. 2 to celebrity news outlets warning against the publication of anything damaging or defamatory about the "Mean Girls" star or her mother Dina Lohan.

The notice, posted on TheSmokingGun.com, follows a press conference held by Lindsay's dad Michael Lohan and his attorney Dominic Barbara earlier that day announcing that they are seeking alimony -- about $3 million, half of the 15 percent of Lindsay's income that she reportedly gives to her mother, who filed for divorce in 2004. Michael Lohan is also requesting that various members of his estranged family undergo tests for drugs and alcohol.

 

Lindsay's attorney writes that "re-publishing malicious falsehoods" made by Michael would not only be "highly damaging and defamatory" to his clients, but may also "constitute evidence of actual malice" if these statements aren't checked for corroboration or refutation.

Beyond this warning, the letter continues with a long and detailed rap sheet of Michael Lohan's offenses, calling into question his trustworthiness and character. Among his run-ins with the law, Lavely lists Lohan's numerous arrests for assault, disorderly conduct, jumping bail, issuing a bad check and thefts of services. Included is his 1990 incarceration for defrauding people in connection with commodities futures trading and for violating the terms for his five-year supervisory release.

Lohan also pleaded guilty in 2000 for harassment for making numerous threatening telephone calls to Dina Lohan and her parents. During one call, he said, "I will come by ad take care of all of you." He made similar "creepy" calls, up to 40 a day, to his own family, saying he'd kill them.

Lavely further cites that Lohan has been caught publicly in several lies. For instance, trying to lay claim to Lindsay's success now negates his statement to Howard Stern in a September 2004 interview in which he says that Dina "was responsible for building up [Lindsay's] entire career" and that he had "nothing to do" with it. Lohan also once claimed that he would never seek alimony.

The letter concludes that outlets should "cease and desist from making, publishing or otherwise disseminating any false or defamatory statements of or concerning either Lindsay Lohan or Dina Lohan" or they "will be exposed to liability and a substantial damage verdict."

Besides the 2004 teen comedy "Mean Girls," Lindsay Lohan's other film credits include "The Parent Trap," "Freaky Friday" and "Confessions of a Teenage Drama Queen." She recently released her debut album, "Speak," and is currently filming "Just My Luck" in New Orleans. Her latest Disney remake, "Herbie: Fully Loaded," will open nationwide in June.
